The agreement
These terms are an agreement between you and Element Fourteen (“we”, “us”). They cover PAWS Reader at paws.elementfourteen.io and this website, elementfourteen.io. By signing in to PAWS Reader, you agree to these terms and to our privacy policy. If you don’t agree, please don’t use PAWS Reader.
PAWS Reader is for teachers and other adults. You must be at least 18 to use it.
If your school or district wants its own agreement, such as a data privacy agreement, write to privacy@elementfourteen.io. A signed agreement with a school takes priority over these terms where the two differ.
A free pilot
PAWS Reader is in an invite-only pilot and is free to use. During the pilot we may add, change or remove features, and we may end the pilot or the service.
If we decide to shut PAWS Reader down, we’ll aim to tell you by email at least 30 days ahead, so you have time to download your data. If we ever start charging, we’ll tell you first, and nothing you already use will start costing money without your agreement.
Your account
- An account is for one person. Don’t share it.
- You sign in with links sent to your email, so anyone who can read your email can sign in as you. Keep your email account secure.
- You’re responsible for what happens in your account. Tell us at support@elementfourteen.io if you think someone else has used it.
No student information
PAWS Reader is built so it never needs to hold student information. Reading groups are named for colours, not children. Don’t enter student names, ID numbers, grades, scores or anything else about a student anywhere in PAWS, including book titles, shelf locations and notes.
If we find student information in an account, we may remove it, or ask you to.
Using PAWS fairly
Please don’t:
- use PAWS Reader for anything unlawful, or to store content you don’t have the right to use;
- try to get into anyone else’s account or data, or test, probe or get around our security;
- overload the service, or use automated tools to access it in bulk;
- copy, resell or rebuild PAWS Reader as your own product.
If you find a security problem, please tell us at support@elementfourteen.io rather than testing it further. We’re grateful for reports.
Your content
What you put into PAWS Reader, such as your book list, group levels and plans, stays yours. You give us permission to store, copy and process it only as needed to run PAWS Reader for you, keep it backed up and keep it secure. We don’t use your content for anything else, and we don’t sell it.
You can download a copy of your data at any time from Settings, and delete your account whenever you like.
If you send us ideas or feedback, we may use them to improve our tools, without owing you anything for them.
What’s ours
PAWS Reader, this website, and the Element Fourteen name and “14 Si” mark belong to Element Fourteen. These terms let you use PAWS Reader. They don’t give you ownership of it, or the right to use our name or mark.
Other companies’ names and sites
Accelerated Reader, ATOS and AR BookFinder are trademarks of Renaissance Learning. PAWS Reader works with AR book levels, but Element Fourteen isn’t affiliated with or endorsed by Renaissance.
PAWS may link to other websites, such as AR BookFinder for a book’s quiz number. We don’t control those sites and aren’t responsible for them.
Ending
You can stop using PAWS Reader at any time, and delete your account in Settings.
We may suspend or close an account that breaks these terms or puts other people or the service at risk. Where it’s reasonable, we’ll tell you first and give you a chance to download your data.
The parts of these terms that by their nature should continue after an account closes, such as “No guarantees” and “Limits on liability”, do.
No guarantees
We work hard to keep PAWS Reader running and your data safe, and we keep backups. But PAWS Reader is provided “as is” and “as available”, especially during the pilot. To the extent the law allows, we make no promises that it will always be available, error-free or free of data loss, and we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Book suggestions and reading levels are aids to your own judgment as a teacher, not instructions. Keep your own copies of anything you can’t afford to lose; the backup download in Settings is there for that.
Limits on liability
To the extent the law allows, Element Fourteen won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, lost profits or lost time, arising from your use of PAWS Reader or this website, even if we were told they might happen.
To the extent the law allows, our total liability for any claim about PAWS Reader or this website is limited to the greater of the amount you paid us in the 12 months before the claim (during the free pilot, nothing) or US $50.
Some places don’t allow some of these limits. Where that’s the case, they apply only as far as the law allows.
Changes, law and contact
If we change these terms, we’ll post the new version here and update the date at the top. If a change is significant, we’ll tell you by email before it takes effect. Continuing to use PAWS Reader after a change means you accept the new terms.
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. If any part of them can’t be enforced, the rest still applies. If we don’t enforce a part of them right away, we haven’t given up the right to later.
